Abstract


One of the fundamental changes on judicial power in the third amendment of UUD 1945 is the distributionof judicial review power to Supreme Court and Constitutional Court. The Supreme Court has the highestjurisdiction to execute the cassation cases and authority to review inferior regulations under law. TheConstitutional Court has the power to review laws against UUD 1945. Unfortunately, the judicial reviewmodel has several potential problems which can ruin the implementation of legal principles. That is whysome changes have to be taken.

 

Salah satu poin mendasar dari penataan kekuasaan kehakiman pada perubahan ketiga UUD NRI Tahun1945 adalah dilakukannya pengaturan kewenangan judicial review atau hak menguji yang dijalankan oleh lembaga pelaksana kekuasaan kehakiman, yaitu Mahkamah Agung dan Mahkamah Konstitusi. Mahkamah Agung berwenang mengadili pada tingkat kasasi, menguji peraturan perundang-undangan di bawah Undang-Undang terhadap Undang-Undang, sedangkan Mahkamah Konstitusi berwenang menguji Undang-Undang terhadap Undang-Undang Dasar. Namun ternyata model kewenangan judicial review semacam ini rentan melahirkan persoalan hukum yang dapat merusak pilar-pilar hukum, sehingga perlu dilakukan penataan ulang.
