FUNGSI HUKUM DAN LEGAL PLURALISM DI BIDANG AGRARIA

Abstract
The aims of this article are to analyze the function of agrarian law at the midst of legal pluralism between state law and indigenous law which prevail in indigenous community as well as the function of agrarian law in responding global legal pluralism. Based on analysis it is found that that in legal pluralism between state law and indigenous law, indigenous law can take role as a tool of social control which is reflection of such a community legal culture. In term of global legal pluralism in agrarian law, globalization must be filtered and adjusted to Pancasila value as margin of appreciation. If that law is according to justice and can bring development and prosperity to society, this law can be used as a tool of social engineering.

Tulisan ini bertujuan untuk membahas fungsi hukum dalam pluralisme hukum agraria antara hukum negara dan hukum adat maupun fungsi hukum dalam menghadapi hukum transnasional yang menimbulkan global legal pluralism. Berdasarkan analisis dapat disimpulkan bahwa hukum adat sebagai dasar hukum agraria nasional dapat difungsikan sebagai a tool of social control pada masyarakat hukum adat karena sesuai dengan budaya hukum masyarakat tersebut dan berorientasi pada pencapaian keadilan substantif. Adapun hukum transnasional yang menimbulkan global legal pluralism apabila hendak diberlakukan di bidang agraria harus dinilai kesesuaiannya dengan Pancasila sebagai margin of appreciation serta tujuan hukum agraria nasional yakni sebesar-besarnya kehidupan rakyat. Apabila hukum transnasional sesuai dengan dua indikator tersebut maka hukum ini dapat difungsikan sebagai a tool of social engineering. Pemfungsian hukum sebagai a tool of social engineering hanyalah berada dalam tataran metodologi pengelolaan hukum agraria nasional dan tidak boleh mengubah ontology atau hakikat hukum agraria nasional yakni komunalistik religious.
