WABAH PENYAKIT DI INDONESIA: KONSEP HUKUM PIDANA TERHADAP CARRIER PENYAKIT MENULAR
Abstract
Abstract
The infectious disease hinders person quality life, creating sickness, and carriers. The challenge of legal enforcement emerges when people did not follow the authority. Low public obedience towards control of disease may cause a disease outbreak or even pandemic. Person attitude that did not follow the public health instruction raises questions about legal basis from making another person sick. This normative research will dive into the concept, especially the role of criminal law on controlling the spread of infectious disease. Finally, the article may invent the appropriate practice of criminal law concept on public health emergencies in Indonesia.
Abstrak
Penyakit menular menyebabkan menurunnya kualitas kehidupan dan menyebabkan keadaan sakit, serta dapat menjadikan seseorang sebagai carrier. Ketidaktaatan masyarakat terhadap upaya kontrol penyakit menular dapat menimbulkan wabah ataupun pandemi. Mobilitas seorang carrier dapat membuat situasi semakin parah dan menimbulkan pertanyaan mengenai dasar pertanggungjawaban hukum ketika membuat orang lain sakit. Artikel ini akan membahas secara normatif dengan menelaah konsep hukum, khususnya hukum pidana yang ditujukan sebagai upaya kontrol persebaran penyakit menular, serta. Telaah ini pada akhirnya menemukan penerapan konsep pidana yang benar terhadap situasi darurat kesehatan masyarakat di Indonesia.
