Abstract


Answering the increasing rate of acquittal verdicts handed on corruption charges, this study analyses judges’ interpretation of corruption and its implication to their judgements. We find that judges perceive corruption in either narrow or broad interpretations. Narrow approach tends to result in acquittal while broad interpretation ends in guilty verdicts.

 

Dilatarbelakangi oleh fenomena jamaknya putusan bebas terhadap tersangka korupsi di pengadilan umum, studi ini mempelajari pemaknaan hakim akan korupsi dan implikasinya terhadap putusan. Hasil studi menemukan bahwa terdapat dua pemaknaan hakim tentang korupsi: pemaknaan sempit dan luas. Pemaknaan sempit cenderung menghasilkan putusan bebas, sedangkan pemaknaan luas cenderung melahirkan putusan bersalah.
